The following User Agreement ("Agreement") sets out the rules and guidelines for access to and use of the AI assistance applications and platforms (collectively referred to as the "Services") offered by Nesa AI ("we," "us," or "our"), based in Cypress, TX, USA. By utilizing our Services, you confirm your acceptance of this Agreement. If you disagree with any part of this Agreement, you should refrain from accessing or using our Services.

User Qualification:

Only individuals who are 13 years of age or older can access or utilize our Services. By accessing or using our Services, you affirm that you are at least 13 years of age and have the legal right, power, and competence to accept this Agreement.

Conduct & Usage:

Our Services should only be used for legal purposes and must comply with this Agreement. You're not permitted to use our Services in any manner that breaches any relevant law or regulation. You're prohibited from using our Services in a way that may harm, disable, overburden, or interfere with any of our servers or networks. Unauthorized attempts to access any Service, other accounts, computer systems or networks linked to any of our servers or any of the Services, by means such as hacking, password mining, or other illicit means, are strictly prohibited.

Pricing:

The pricing for our Services is available on our website and can be revised periodically without prior notification. All fees are final and cannot be refunded unless expressly stated by us in writing.

Cancellation:

We reserve the right to revoke your access to any or all parts of our Services at any point and without prior notice, for any reason we see fit, including, but not limited to, a violation of this Agreement. On termination of your account for any reason whatsoever, all privileges granted to you under this Agreement shall cease immediately, and you must halt using the Services without delay.

We make no promises about the accuracy, dependability, or quality of any content accessed through our Services.

Liability Limitations:

Under no circumstance shall we be held accountable for any damages that result from your usage of the Services, including but not limited to direct, indirect, incidental, punitive, and consequential damages, even if we have been made aware of the possibility of such damages.

Compensation:

You agree to defend, indemnify, and hold us harmless against all claims resulting from your use of the Services. This includes, but is not limited to, claims made by third parties relating to infringement of intellectual property rights or violations of relevant laws and regulations.

Intellectual Property Rights:

All branding, graphics, logos, designs, and any other content displayed on the Nesa AI platform remain our exclusive property and cannot be used without our explicit written consent. We agree to share with the user the intellectual property of the content generated by the user. This includes, but is not limited to, the user's AI assistant interactions, generated logs, and generated text. However, we will not share any other user's intellectual property, such as account information, email address, and password, with any third party, except as required by law.

General Provisions:

This Agreement represents the complete understanding between you and us regarding your use of the Services, superseding all prior arrangements. This Agreement shall be interpreted according to the laws of Texas, United States. Any disputes that arise from this Agreement shall fall under the exclusive jurisdiction of courts
